To Sign up for Lake Tahoe On Line Dial-up Internet Service you must read the conditions herein.
This agreement supersedes any other written or oral agreement and represents the complete agreement and understanding between you "Customer" and Lake Tahoe On line (LTOL). We reserve the right to change these terms and conditions and/or change the prices charged and/or services rendered or discontinued by publishing changes on-line via www.ltol.com or by e-mail at least 10 days before the effective date of change.  Your use of Lake Tahoe On Line services constitutes your acceptance of these terms and conditions.
Term of Agreement: This agreement remains in effect until, either you close your account or Lake Tahoe On Line cancels your account.  Registration and account information updates may be required in order to stay a current customer of LTOL. It is your responsibility to  notify LTOL  in writing or by e-mail of any account information changes. Using Lake Tahoe On Line after the effective date of this agreement constitutes your acceptance of these  terms and conditions. If you do not agree to these terms and conditions, proper written notice must be submitted in writing to Lake Tahoe On Line 12242 Business Park Dr. Ste. #2.  Lake Tahoe On Line reserves the right to terminate any account at any time for any reason
Billing/Terms/Termination: Lake Tahoe On line will send out statements, or will bill your credit card for monthly dues and connection fees as set forth in the current LTOL rate schedule. We reserve the right to modify the rate schedule by submitting notifications of changes to you by e-mail or written notice at least ten days before the modification date.  Lake Tahoe On Line does not issue refunds for partial months unless service is canceled within (7) days of  your account being first enabled. Termination and other change requests by you for your accounts must be received in writing via e-mail, fax, or mail. sent to: Lake Tahoe On Line 12242 Business Park Dr. Ste #2 Truckee, CA 96161 by the 15th of the month preceding your desired discontinuation of service. Your account will then be suspended on the first of the following month.   The first day that your account is enabled is the first day of your accounting cycle.  The first bill will consist of charges for the prorated month from that day to the end of the current month plus any activation fees. Lake Tahoe On line will thereafter bill on or around the 25th of the month for the following months service.  You must notify Lake Tahoe On Line by the 15th of the month to change type of account or method of payment. There is a $15.00 service charge for each returned check or decline credit card charge. Delinquent accounts will be placed on "accounting hold" on the 20th of the month if payment has not been received.  "Held" accounts may not be used until the account is brought up to date, including any returned check or declined credit card service charges. Accounts that are unpaid by the 25th may be terminated at our discretion.  Accounts that have been terminated may be reinstated upon payment of any outstanding charges and the account setup charge of $20. Lake Tahoe On Line delinquent account continue to accrue charges  while they are on accounting hold. All accounts delinquent accounts will be terminated by the 30th of the month of the past due billing cycle. You are responsible for all fees up to the date of termination of the service, except for where LTOL is not able to provide services under this agreement through its own negligence.
 Refunds and Multiple Month Prepayments:  LTOL allows you to receive discounts for entering into prepaid multiple month contracts. If the customer is unsatisfied with the Internet service for any reason within the first seven (7) days of service the customer may cancel and receive a full refund minus setup fees. After the first seven (7) days, customer agrees that all sales are final and no refund are made.
Service: Lake Tahoe On Line will provide services  to it's customers in exchange for payment of fees and compliance with the terms and conditions set forth herein. Lake Tahoe On Line services are defined as the use by Customer of computing, telecommunications, software, and information services provided by Lake Tahoe On line. Misc. services are sometimes provided by others via the World Wide Web(WWW). We do not offer or guarantee secure private communication over our networks.
Password Security: LTOL  dial-up accounts are individual accounts.  These accounts allow one user with a secure password to access the internet. Sharing of account information (Passwords) is not allowed. You agree to keep your account information confidential.
Use of Internet Services: You agree to use the services provided by Lake Tahoe On Line as permitted by applicable local, state, and federal laws. You agree to not: mass post unsolicited e-mail (spamming), disrupt the normal use of the LTOL system (NO Hacking), stay on-line when not really "active".  Unlimited access for a single user account is defined as your staying actively on line (in front of your computer). This means no checking e-mail automatically every 10 minutes.   Idle sessions will time out in 20 minutes.  You may not attempt to defeat the idle time out properties in any way. Any use of Lake Tahoe On Line that disrupts the normal use of the system for other Lake Tahoe On Line customers is considered to be an abuse of system resources and is grounds for immediate blacklisting.  LTOL reserves the right to terminate connections with time outs less than 20 minutes during peak hours. You agree to indemnify and hold Lake Tahoe On Line harmless against losses resulting from your use of the service which damages you or any third party.
Adult Content: The internet is sometimes less than pristine, so if you are under 18 years old we require a letter of consent from your parent or guardian authorizing your use of LTOL.

Content: Lake Tahoe On Line has the right to examine and/or remove any online materials, including news, email, and user files as a part of it's administrative capacity.

Warranties: Lake Tahoe On Line makes no warranties of any kind, whether expressed or implied, for its services and specifically disclaims any implied warranties of merchantability or fitness for any particular purpose. Lake Tahoe On Line will not be responsible for any losses or damages resulting from delays, nondeliveries, misdeliveries, service interruption, or your errors or omissions. Lake Tahoe On Line will not under any circumstances be responsible for consequential damages.

Calling Areas/Toll Free Calls: Lake Tahoe On Line has many phone numbers throughout California and Nevada for local toll-free calling, but it is the responsibility of the user to make sure that the number given by any employee of Lake Tahoe On Line is actually a toll free call. Lake Tahoe On Line will not be responsible for any charges to the users phone bill.  The user agrees to this and will hold Lake Tahoe On Line harmless in the event of additional charges to the user's phone bill.

Arbitration: Any legal action shall be completed prior to two years from the date of grievance. The prevailing party in any such dispute shall be entitled to reasonable costs, including collections costs, and attorney fees. In the event that any disputes arise either party has the right to initiate arbitration by a state licensed impartial arbitrator that is not associated with either party.

Severability. If any provision of this agreement is held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this agreement will remain in full force and effect.

Effective date. This agreement shall become effective when your access to Lake Tahoe On Line is enabled.

This agreement is made between Lake Tahoe On Line (LTOL) and the Web Hosting Customer ("Customer").

Services: Lake Tahoe On Line agrees to provide Web site hosting, Domain Name Services, and other related services to the Customer with the  following terms and conditions.

Content & Indemnification: Customer acknowledges that Lake Tahoe On Line does not regulate or take any responsibility for the content of its page or for the security of Customer's password. The Customer warrants that it has all rights necessary to lawfully submit any information or materials that it is uploading or transmitting to Lake Tahoe On Line, including all intellectual property rights. The Customer agrees to indemnify Lake Tahoe On Line against actions brought by a third party as a result of such material or information, or as a result of Customer's use in any way of the Services provided by Lake Tahoe On Line.

Termination: In the event that Lake Tahoe On Line at any time reasonably believes that the Customer is in breach of any of the terms and conditions contained in this agreement or is using Lake Tahoe On Line's services in an unacceptable manner, Lake Tahoe On Line may immediately terminate this agreement without liability. Lake Tahoe On Line may terminate this contract with 30 days notice to Customer for any reason or for no reason. Customer may terminate this contract at any time by notifying Lake Tahoe On Line in writing at least 15 days before the scheduled termination day. At the time of notification, Customer shall be responsible for the entire amount of the most recent statement.

Warranties: Lake Tahoe On Line makes no warranties of any kind, whether express or implied, for the services to be provided. Customer agrees that Lake Tahoe On Line shall not be liable for any losses or damages of any kind to Customer, including, but not limited to, those that may result from service interruptions, delays, non-deliveries, or misdeliveries. Also, Lake Tahoe On Line makes no warranties regarding its ability to recover any lost file, regardless of how or why the file was lost.

Billing Policies: Service invoices will be sent to Customer in advance of receiving services and will be in accordance with the Billing policies and service rates as set forth on the LTOL Web Hosting Rates page. Customer agrees to submit payment for all statements upon receipt. Accounts 30 days past due are subject to suspension and a service resumption fee of $20.00. Accounts 45 days past due are subject to cancellation which will result in deletion of all of Customer's files. Customer agrees that submission of credit card information to Lake Tahoe On Line constitutes authorization by Customer for Lake Tahoe On Line to bill the specified credit card for all fees owed by customer to Lake Tahoe On Line

Amendments: Lake Tahoe On Line reserves the right to make amendments or changes to this agreement with 10 days notice by e-mail or mail to Customer. LTOL reserves the right to make changes to the pricing schedule with 10 days notice by e-mail or mail to customer.

Acceptance of Terms: Use of Lake Tahoe On Line Web Hosting services constitutes acceptance of the terms and conditions contained in this agreement and any amendments.

Litigation/ Attorney's Fees/Arbitration: In the event of any dispute arising out of or relating to this agreement all action will be concluded within two years of the grievance and the prevailing party in any such dispute shall be entitled to reasonable costs, including collection costs, and attorney's fees. In the event that any disputes arise either party has the right to initiate arbitration by a state licensed impartial arbitrator that is not associated with either party.

Agreement: This represents the complete agreement and understanding between Lake Tahoe On Line and Customer with respect to the subject matter herein. In the event that any term or provision of this agreement is held by a court to be unenforceable, then the remaining provisions shall remain in full force and effect.
